Terms and Conditions
Terms and conditions of sale
These Terms and Conditions of Sale, together with the rules governing use of the website www.apodemia.com, expressly govern the sale and purchase relationship between Apodemia, S.L., Spanish Tax Identification Number (CIF) B-86615085, with registered office at Calle de José Castán Tobeñas, 1, 28020 Madrid, Spain, registered with the Madrid Companies Registry under Volume 30,566, Folio 53, Entry 1, Sheet M-550100 (hereinafter, “Apodemia”), and the user purchasing Apodemia-branded items through www.apodemia.com (hereinafter, the “Customer”).
Purchasing Apodemia products through the website constitutes express and unconditional acceptance of these Terms and Conditions. The Customer accepts them by clicking the “Pay now” button during checkout.
Apodemia may amend these Terms and Conditions. Any revised terms shall apply from the date they are published on www.apodemia.com and shall not affect orders that have already been confirmed.
Materials and finishes
All Apodemia creations are made using carefully selected materials and are subject to quality controls. Unless otherwise stated on the product page, all jewellery is plated with 3 to 5 microns of recycled 18-carat gold; silver pieces feature a rhodium-plated finish. The plating thickness may vary depending on the structure of each piece in order to optimise durability and design. Apodemia assesses the appropriate thickness to maximise quality and durability without compromising the design.
Jewelry warranty
APODEMIA S.L. provides a three-year legal guarantee covering manufacturing defects and faults only. Defects caused by use are not covered by the guarantee. Any exchange or return is subject to assessment by the Quality Department, which will issue its decision within a maximum of 15 working days. For exchanges of purchases made from APODEMIA S.L., customers may use our stores* and/or the company’s official website, www.apodemia.com. For further information, please contact info@apodemia.com.
Breakages will be assessed by a specialist team to determine whether they result from a manufacturing defect. Apodemia does not cover damage caused by use, including impacts, breakage resulting from handling, attempted repairs by third parties, alterations, wear and ageing, or metal fatigue resulting from continued use, as well as failure to follow the product care instructions. The legal guarantee covers manufacturing defects or lack of conformity existing at the time of delivery only. Our jewellery is delicate by nature and must therefore be handled and cared for accordingly.
APODEMIA S.L. accepts exchanges within 30 calendar days, provided that the products have not been used and that the original packaging, label and brand seal remain in perfect condition. The original purchase receipt must be presented, and the seal and/or security sticker must be in perfect condition. Exchanges and returns are not accepted for the perfume or headpiece collections, or for exclusive pieces modified at the Customer’s request, such as items with engravings or embroidery. For Forever exchanges, the relevant certificate must also be provided in addition to the receipt.
The guarantee applies only to products manufactured by Apodemia S.L. It may be claimed at any APODEMIA store or by contacting info@apodemia.com.
Any potential lack of conformity will be assessed by the Quality Department. Exercising the legal guarantee does not require packaging or seals to be kept in “perfect condition”, without prejudice to the Customer taking reasonable protective measures when shipping the item.
Engravings and embroideries.
Depending on the piece, engraving is carried out using a pantograph, at the workshop’s discretion. Available typefaces will be specified on the product page. To confirm a style or provide specific instructions, the Customer may email info@apodemia.com.
Personalised products or products made to the Customer’s specifications (for example, engraved items) are not eligible for withdrawal or exchange, except where they have a lack of conformity.
Exchanges, Returns and right of withdrawall
1. Commercial exchange policy. Without prejudice to statutory rights, Apodemia accepts exchanges within thirty (30) calendar days of delivery, provided that the product has not been used and retains its original packaging and, where applicable, its seal or security label in good condition. If the purchase included a promotional gift, the gift must also be returned unused in order to make an exchange. For “Forever” collections, the relevant certificate is required.
2. Right of withdrawal (online purchases). The Customer has fourteen (14) calendar days from receipt of the order to request a refund. The request must be submitted through our exchanges and returns portal or by sending an unequivocal statement to info@apodemia.com.
- Effects of withdrawal: Apodemia will refund the cost of the product, excluding delivery costs where applicable. Apodemia may withhold the refund until it has received the product and checked that it has not been used and that its original packaging and, where applicable, seal or security label are in good condition. The refund will be made using the same payment method.
- Return costs: Unless Apodemia offers otherwise, the Customer will bear the direct cost of returning the goods if this was clearly and comprehensibly disclosed before purchase. We recommend using a courier service due to the nature of the product. Exchanges or returns sent carriage forward will not be accepted.
- Diminished value: The Customer shall be liable for any reduction in the value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
- Exceptions: The right of withdrawal does not apply to personalised products or products made to the Customer’s specifications, or to sealed products that are unsuitable for return for health protection or hygiene reasons and that have been unsealed after delivery (e.g. certain perfumes or headpieces). The right of withdrawal does apply if such products remain sealed.
3. How to make a request.
- Website orders: Commercial exchanges and returns may be managed through the exchanges and returns portal (Reveni). The product must be dispatched within a maximum of 5 days from the date the exchange or return is requested through the Reveni portal. However, the right of withdrawal may also be exercised by sending the relevant form or an unequivocal statement to info@apodemia.com, or by post to Apodemia’s registered address.
- In-store exchanges: Only ring-size exchanges for online orders may be carried out in Apodemia stores (excluding El Corte Inglés locations). All other exchanges and returns for website orders should preferably be managed through Reveni or by the statutory methods indicated above.
Internal processing times. Condition checks may take up to fifteen (15) days from receipt of the returned product. This shall not affect the statutory refund deadline applicable to withdrawals.
Products and availability
Product photographs and descriptions are for illustrative purposes. Due to reasonable technical limitations, slight variations in colour or shade do not in themselves constitute a binding contractual offer. In all cases, the product page will clearly and comprehensibly set out the essential characteristics of each item.
All orders are subject to availability. If a product becomes unavailable after an order has been placed, Apodemia will inform the Customer without undue delay and refund any amounts paid without undue delay. Alternatively, and only with the Customer’s express consent, a product of the same price may be supplied; the Customer’s right of withdrawal shall remain unaffected.
Apodemia is not responsible for incidents attributable to the Customer’s internet connection that temporarily prevent completion of a purchase. If a technical incident results in an improper charge, Apodemia will issue the corresponding refund without undue delay.
Apodemia may update, remove or amend products, content or information on the website, without affecting orders that have already been confirmed.
